The New York State Department of Health has officially declared influenza prevalent in New York State for the 2026–2027 flu season. This declaration comes earlier than in previous years and reinforces the importance of seasonal influenza prevention and protecting patients and healthcare workers.
Under Section 2.59 of the New York State Sanitary Code (10 NYCRR § 2.59), healthcare personnel who have not received the current season’s influenza vaccine are required to wear a surgical or procedure mask while in areas where patients or residents are typically present.
This requirement applies to healthcare and residential facilities and agencies regulated under Articles 28, 36, or 40 of the New York State Public Health Law. The masking requirement will remain in effect until the Commissioner of Health determines that influenza is no longer prevalent in the state
